IMPORTANT

Membership-based citation reimbursement.

Umbrella Ticket Solutions provides access to reimbursement benefits for eligible traffic citations under the terms and limits of a driver's membership.

UTS is not a law firm and does not provide legal advice or legal representation. The UTS membership is not an automobile insurance policy and does not replace automobile insurance required by law.

01

Acceptance of Terms

These Terms of Use ("Terms") are an agreement between you and Umbrella Ticket Solutions LLC ("Umbrella Ticket Solutions," "UTS," "we," "our," or "us") governing your use of our website, member portal, membership services, and citation reimbursement program.

By creating an account, purchasing or renewing a membership, submitting a claim, or otherwise using the Services, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you should not purchase or use the Services.

A person purchasing or managing a membership must be legally capable of entering into a binding agreement.

02

Nature of the Service

Umbrella Ticket Solutions provides a membership-based citation reimbursement service. Members may become eligible for reimbursement of qualifying traffic citation amounts under the rules, limits, and benefits of the membership selected for the applicable driver.

Umbrella Ticket Solutions is not an automobile insurance policy and does not replace any insurance required by law.

References on the website to "coverage," "covered driver," or similar terms describe eligibility under the UTS membership program only. They do not mean automobile insurance coverage.

Membership does not transfer responsibility for a citation, court appearance, response deadline, payment deadline, license status, or other legal obligation from the cited driver to Umbrella Ticket Solutions.

03

No Legal Advice or Representation

Umbrella Ticket Solutions is not a law firm and does not provide legal advice or legal representation.

A member remains responsible for deciding whether to pay, contest, seek reduction of, appear in court regarding, or otherwise respond to a citation. If legal advice is needed, the member should consult a qualified attorney.

Nothing provided by UTS should be interpreted as a prediction or guarantee concerning the outcome of a citation or legal proceeding.

04

Membership Plans and Covered Drivers

Membership benefits are assigned to an individual driver and an individual subscription. Each driver must have an applicable active membership in order to have citation reimbursement eligibility.

Benefits, balances, claims, and reimbursement eligibility are not pooled or transferred between drivers, including between a primary account holder and additional drivers.

Membership levels may have different prices, maximum annual benefits, eligible violation types, and other benefits. The plan information displayed when a membership is purchased forms part of these Terms.

05

Waiting Period and Effective Date

New memberships currently have a 24-hour waiting period. A citation must be issued after the applicable driver's membership has completed its waiting period and become effective.

Citations issued before the membership effective date and time are not eligible. Membership is not retroactive.

The member portal may display the applicable membership status and effective timing for each driver.

06

Eligible Citations and Plan Rules

Citation eligibility depends on the membership plan in effect for the cited driver on the date the citation was issued. Only violation categories included in that membership are eligible.

Current plans limit eligible speeding citations to no more than 20 miles per hour over the posted speed limit. A violation outside an applicable plan limit is not eligible for reimbursement.

The fact that a citation can be submitted through the website does not itself establish eligibility. UTS reviews each submitted claim against the applicable membership rules.

Standard individual memberships are for personal, non-commercial driving.

Citations received while operating a commercial motor vehicle, or citations arising from CDL or commercial driving, are not eligible under standard individual memberships unless a separate UTS commercial membership or applicable written plan terms expressly provide that coverage.

Holding a standard personal membership does not extend reimbursement eligibility to a citation received during commercial or CDL-regulated operation.

A citation resulting from fraud, misrepresentation, deliberate abuse of the program, or information that cannot reasonably be verified may be denied.

07

Claim Submission Window

An eligible citation must currently be reported through the member portal within 30 days of the citation date.

Starting a claim within the reporting window does not require the member to immediately pay the citation or abandon an effort to contest or reduce it.

Claims submitted outside the applicable submission period may be ineligible.

08

Claims and Documentation

Members must provide accurate citation information and the documents reasonably required to verify a claim. The current claim process requires clear copies or photographs of the front and back of the citation.

UTS may request additional documents or information, including court notices, amended citations, payment information, dismissal records, or final-disposition documents where relevant.

A claim may be placed into a More Information Required status while additional information is needed. Failure to provide reasonably requested information may prevent the claim from being approved.

Submission of a claim is not a guarantee of approval or reimbursement.

09

Contesting or Reducing a Citation

A member may contest a citation or seek to have the charge or fine reduced before paying it. When appropriate, the claim may remain open while the citation is being resolved.

The member should upload relevant court or final-disposition documents as they become available so that UTS can evaluate the final reimbursement amount.

UTS does not direct or control the member's legal strategy and does not guarantee any reduction, dismissal, or court result.

10

Available Benefit and Reimbursement Amount

Each active driver membership has its own available benefit balance. The amount available for a claim is subject to the applicable membership limits and the driver's current available benefit.

The requested reimbursement initially defaults to the lesser of:

  • the eligible citation amount; or
  • the exact available benefit for the applicable driver and subscription.

A member may voluntarily request a lower reimbursement amount. A displayed or reserved amount during claim processing is not a final payment guarantee. Final reimbursement remains subject to claim approval.

11

Benefit Accrual and Maximum Benefit

Membership plans have an annual maximum benefit. Benefit becomes available according to the billing cadence and benefit rules of the purchased membership.

For monthly memberships, successful recurring payments may add benefit according to the applicable plan's monthly accrual rules. For annual memberships, benefit is made available according to the annual plan rules after the applicable successful payment.

Reimbursements reduce the available benefit for the applicable driver and subscription. Benefit does not exceed the plan's applicable maximum.

12

Billing and Automatic Renewal

Membership fees are billed according to the monthly or annual billing option selected at enrollment. Unless canceled, memberships may automatically renew according to the selected billing cadence.

Payment processing is provided through Stripe or another payment processor designated by UTS. UTS does not require members to provide UTS personnel with full payment-card credentials.

By purchasing a recurring membership, you authorize the applicable recurring charges until cancellation in accordance with these Terms.

Prices, billing cadence, and plan benefits applicable to a purchase are displayed during the membership process.

13

Failed Payments and Membership Status

A failed, reversed, disputed, or otherwise unsuccessful membership payment may affect membership status and the availability of new benefits or new claim eligibility.

UTS may attempt to reconcile membership status with the payment processor and may require a valid payment method before membership benefits continue.

Members are responsible for maintaining accurate billing and account information.

14

Cancellation

A member may request cancellation of a membership. When a membership is scheduled to cancel at the end of the current paid billing period, it may remain active through that period unless otherwise indicated in the member account.

Once membership coverage ends, citations issued after the end of coverage are not eligible.

A claim involving a citation issued while the applicable membership was active may continue to be reviewed after cancellation if the citation was otherwise eligible and the claim was submitted within the applicable claim submission period.

15

Unused Benefit and Re-enrollment

Unused benefit does not carry over after a membership ends and cannot be transferred to another driver, another subscription, or a future membership.

A former member may be permitted to enroll again. Re-enrollment creates a new membership and benefit lifecycle. Unused benefit from an ended membership is not restored or transferred to the new membership.

Historical subscription, payment, claim, and benefit records may be retained for recordkeeping, support, fraud prevention, and other legitimate business or legal purposes.

16

Member Responsibility for Citations

The cited driver remains solely responsible for complying with all citation, court, and governmental deadlines.

Members should not delay a required response, appearance, or payment solely because a UTS claim is pending.

Except to the extent required by applicable law, UTS is not responsible for late fees, court costs, warrants, license suspension, reinstatement charges, towing or impound charges, increased penalties, missed court appearances, or other consequences resulting from a member's failure to timely respond to a citation or legal proceeding.

17

Fraud, Misrepresentation, and Abuse

Members may not knowingly submit false, altered, misleading, duplicated, or fraudulent information or documents.

UTS may investigate suspected fraud, material misrepresentation, payment abuse, identity misuse, manipulation of benefit balances, or other misuse of the Services.

When reasonably supported by the facts, UTS may deny an affected claim, restrict account access, cancel or terminate a membership, or take other appropriate action consistent with these Terms and applicable law.

18

Account Security and MFA

Members are responsible for maintaining the security of their account credentials and for promptly reporting suspected unauthorized access.

UTS may require multi-factor authentication and other security measures as a condition of accessing an account or performing sensitive actions.

Members may not attempt to access another person's account or circumvent account, authentication, or security controls.

19

Electronic Communications

You agree that UTS may provide account, membership, billing, claim, security, and other service-related communications electronically, including through the member portal and email address associated with your account.

You are responsible for maintaining a current email address and reviewing important account communications.

Electronic records and notices may satisfy applicable written-notice requirements to the extent permitted by law.

20

Website and Service Availability

We work to keep the website and member portal available and accurate, but uninterrupted or error-free operation cannot be guaranteed.

Temporary outages, maintenance, payment processor interruptions, third-party service failures, or other technical issues do not eliminate a member's independent obligation to comply with citation or court deadlines.

If a technical problem materially affects a member's ability to use the Services, the member should contact UTS as soon as reasonably possible.

21

Refunds

Membership payments are generally non-refundable once earned for the applicable membership period, except where a refund is expressly offered by UTS or required by applicable law.

Cancellation of a membership does not by itself create a right to reimbursement of prior membership payments.

Any approved refund may be returned through the original payment method or another reasonable method determined by UTS and its payment processor.

22

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

UTS does not guarantee that a particular citation will qualify, that a court or agency will accept a particular resolution, that a citation will be reduced or dismissed, or that use of the Services will prevent changes to a member's driving record or automobile insurance costs.

23

Limitation of Liability

To the maximum extent permitted by law, UTS will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

24

Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses arising from your fraudulent or unlawful use of the Services, your material violation of these Terms, or information or documents you knowingly submit without lawful authority.

25

Changes to Memberships or These Terms

UTS may update these Terms, membership offerings, prices, features, or program rules from time to time.

Material changes will be communicated by reasonable means, which may include posting updated Terms on the website, notice through the member portal, or email.

Changes will not be used to retroactively convert a citation that was ineligible when issued into an eligible citation, or to retroactively remove an eligibility right already established under an applicable membership, except where required by law or necessary to correct fraud or material error.

26

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of- law principles, except where applicable law requires otherwise.

Nothing in these Terms waives rights or remedies that cannot legally be waived.

27

Severability and Entire Agreement

If a provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

These Terms, together with the applicable membership plan information, Privacy Policy, and other policies expressly incorporated by reference, form the agreement governing use of the Services.

MEMBER LOGINVIEW FAQ

Excluded Serious or Criminal Offenses.

UTS does not provide reimbursement for reckless driving, racing, DUI/DWI or other alcohol- or drug-related driving offenses, hit-and-run, fleeing or evading law enforcement, vehicular offenses involving injury or death, or other citations or charges classified as criminal offenses rather than ordinary traffic violations.

Extraordinary Claims Payment Contingency

In the event an extraordinary or overwhelming volume of otherwise eligible reimbursement claims makes it financially impracticable for Umbrella Ticket Solutions to pay all approved reimbursement benefits when due, UTS may, in lieu of the unpaid reimbursement benefit, refund the affected member’s membership fee attributable to the month in which the applicable citation occurred. For a membership billed annually, the applicable monthly amount will be calculated as one-twelfth (1/12) of the annual membership fee. This provision applies only where the claim would otherwise qualify for reimbursement and the inability to pay is due to the extraordinary aggregate volume of eligible claims rather than any act, omission, ineligibility, exclusion, fraud, misuse, or violation of these Terms by the member or covered driver.

Membership Fees, Claim Decisions, Refunds, and Payment Disputes

Membership fees are charged in exchange for maintaining access to the UTS membership program and its applicable benefits during the paid membership period. Membership fees are not conditioned upon a member receiving a citation, submitting a claim, or having any particular claim approved or reimbursed.

The denial, reduction, exclusion, or ineligibility of a particular claim; exhaustion or unavailability of benefit amounts; the absence of any claims during a membership period; or dissatisfaction with a claim determination does not retroactively invalidate the membership or create a right to a refund of previously paid membership fees except where a refund is expressly provided by these Terms or required by applicable law.

Members authorize recurring membership charges according to the billing interval selected at enrollment until cancellation takes effect under these Terms.

If a member believes a membership charge was made incorrectly, the member is encouraged to contact UTS promptly so the matter can be reviewed. A member should not initiate a payment dispute or chargeback merely because a traffic citation or reimbursement claim is excluded, denied, reduced, exceeds the available benefit, or otherwise does not qualify under the membership terms.

UTS reserves the right to contest payment disputes and chargebacks and to provide the applicable payment processor, card network, financial institution, or issuing bank with relevant records demonstrating the validity of a membership charge, including enrollment records, accepted terms, billing records, membership status, benefit activity, communications, and claim determinations, as permitted by law.

If a membership payment is reversed, charged back, or otherwise returned to the member, UTS may treat that payment as unpaid and may make corresponding adjustments to membership status or benefits attributable to that payment, to the extent permitted by applicable law.

Nothing in this section limits any consumer right or remedy that cannot lawfully be waived.
